1. General Refund Policy

No Refunds Policy: All Peak subscription fees are non-refundable except as specifically outlined below or as required by applicable law.

1.1 Why No Refunds

Peak operates on a no-refunds policy because:

  • We provide a 3-day free trial to evaluate all features before purchase
  • F.R.I.D.A.Y. AI services incur immediate processing costs upon use
  • Digital services are delivered instantly and cannot be "returned"
  • Subscription benefits are available immediately upon payment

1.2 Subscription Pricing

Current Pricing:

  • Free Trial: 3 days, up to 3 projects (No charge)
  • Standard Plan: $49.99/month
  • Unlimited Plan: $99/month

2. Exceptional Refund Circumstances

2.1 Technical Issues

Service Availability Issues: If Peak experiences significant downtime (>48 continuous hours) preventing service access, you may be eligible for a prorated refund for the affected period.

2.2 Billing Errors

We will issue refunds for:

  • Duplicate Charges: If you are charged twice for the same subscription period
  • System Errors: Charges made due to payment processing system errors
  • Unauthorized Charges: Charges made without your authorization

2.3 Legal Requirements

Refunds will be provided as required by applicable law, including:

  • Consumer protection laws in your jurisdiction
  • Credit card company dispute requirements
  • Bank chargeback procedures

3. Cancellation Policy

3.1 How to Cancel

Cancellation Methods:

  • Account Settings: Cancel directly through your Peak account dashboard

  • Include: Account email, reason for cancellation (optional)

3.2 Cancellation Effects

  • Immediate Effect: Prevents future billing cycles
  • Access Continues: Full access until current billing period ends
  • Data Retention: Account data maintained for 30 days after expiration
  • No Refund: Current subscription period is not refunded

3.3 Free Trial Cancellation

Cancel Anytime: You can cancel your free trial at any point during the 3-day period without any charges. If you don't cancel before the trial ends, you'll be automatically charged for the selected plan.

4. Refund Request Process

4.1 How to Request a Refund

  • Timeline: Submit within 7 days of the charge in question

4.2 Review Process

  • Initial Review: 3-5 business days
  • Investigation: Additional 5-10 business days if needed
  • Decision: Written notification of approval or denial
  • Processing: Approved refunds processed within 10 business days

4.3 Refund Methods

Approved refunds will be processed:

  • Original Payment Method: Credit card or bank account used for payment
  • Processing Time: 3-10 business days depending on your financial institution
  • Full Amount: Complete charge amount (no processing fees deducted)

5. Payment Processing & Disputes

  • We'll work directly with Stripe to resolve issues

5.2 Chargeback Policy

Contact Us First: Before initiating a chargeback with your bank or credit card company, please contact us directly. Chargebacks may result in account suspension and additional fees.

5.3 Failed Payments

  • Payment Retry: Automatic retry for failed payments within 7 days
  • Account Status: Temporary suspension if payment fails after retries
  • Grace Period: 10-day grace period to update payment information
  • Account Termination: Account may be terminated after grace period

6. Special Circumstances

6.1 Account Termination by Covalent

If we terminate your account for Terms of Service violations:

  • No Refund: No refund for remaining subscription period
  • Immediate Effect: Account access terminated immediately
  • Data Export: 30-day grace period to export data (if requested)

6.2 Service Discontinuation

Service Changes: If we discontinue Peak or significantly reduce core functionality, we will provide prorated refunds for unused subscription periods and 60 days advance notice.

6.3 Pricing Changes

  • Advance Notice: 30 days notice for price increases
  • Current Subscription: No mid-cycle price changes
  • Cancellation Right: Cancel before price increase takes effect
  • No Refund: Price changes do not qualify for refunds
